Introduction

Welcome. Prodigy Dance Convention, a Delaware limited liability company ("Prodigy," "Company" or "we," "our" or "us"), understands that privacy is important to you and wants you to know that we are committed to safeguarding your Personal Information (defined below). As a result, we want to provide you with a clear picture of how the Personal Information that you provide to us is processed, managed, and protected by us, and what your choices are with respect to that information.

This Privacy Policy is global in nature and governs the Company's websites https://www.prodigydanceconvention.com, all subdomains, and all portals (the "Sites" or "Websites"), and other items that post a link to this Privacy Policy and applies to personally identifiable information from or about an individual ("Personal Information") that we may collect from you.

Prodigy hosts dance conventions at which we provide dance instruction to our attendees, facilitate attendance by college dance team recruiters to identify prospective team members, and offer merchandise for sale. We also provide a digital scouting platform, The Vault, to connect dancers and college recruiters. Our websites, our digital scouting platform "The Vault," and these instructional, recruiting, and sales offerings are collectively referred to as the "Services."

If you voluntarily provide your information in the course of interacting with our Sites or otherwise using our Services, we will take that as your agreement to our collection, use, and disclosure of your information as set forth in this Privacy Policy.

This Privacy Policy does not apply to any products, services, websites, or content that are offered by third parties ("Third Party Services"), which are governed by their respective privacy policies.

What Information We Collect

(a) Information You Provide to Us

The type of information you provide to us depends on the nature of your interaction with the Sites and our Services.

FROM USERS OF OUR SERVICE:

We may ask users of our Services to provide us with certain basic information depending on the manner in which you interact with our Services, all of which is referred to as "Personal Information" including:

  • First and Last Name
  • Email Address
  • Home Or Business Address
  • Telephone Number or Mobile Number
  • Username
  • Date of birth
  • Academic information, such as GPA
  • Online identifiers (account name/password)
  • Payment information
  • Audio and video data
  • Web analytics and other information that could reasonably be used to identify you personally or identify your household; and
  • Demographic information, such as your country, state, or county of residence or business operation ("Demographic Information")

We may also automatically receive and record information from your browser or Device when you visit and interact with the Sites or use the Services. This information may include:

  • Your Internet Protocol (IP) address, browser type and language, and cookie information;
  • Referring and exit web pages and URLs;
  • The areas within our Sites that you visit and your activities there, including remembering you and your preferences;
  • Your Device location or other geolocation information, including the zip code, state or country from which you accessed the Services;
  • Your Device characteristics; and
  • Certain other Device data, including the time of day you visit our Sites.

(b) Information We Collect When You Interact with Third-Party Sites

The Services may include functionality that allows certain kinds of interactions between the Sites and your account on a third-party website or application. The use of this functionality may involve the third-party operator providing certain information, including Personal Information, to us.

(c) Information from Trade Shows and Conferences

If you visit us at third-party trade shows, conferences, or similar in-person events, we may receive your contact information from you directly (for example, if you give us a business card or fill out a form at an event).

(d) Information from "The Vault" Digital Scouting Platform

"The Vault" is a digital scouting platform that dancers may purchase as an add-on to their experience at Prodigy. Dancers who choose to participate can create a profile that includes information they choose to provide (such as biographical details, dance experience, and videos or links to videos). College dance team recruiters who attend our events are given access to The Vault so they can review dancer profiles for potential recruitment purposes. We host and administer The Vault and process the information contained in dancer profiles in accordance with this Privacy Policy and any additional notices provided at the time of sign-up.

(e) Location Data

We may obtain information about your location to provide customized Services, content, and other information that may be of interest to you. If you no longer wish for us to track your location, you may turn off location services on your Device.

(f) Inferences

Using the other pieces of personal information collected about you, we may draw inferences about you, reflecting what we believe to be your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.


Marketing Information

Testimonials

We display videos of competition participants and dance instructors on our Sites. With your consent, we may post your testimonial along with your name on the Sites. If you want your testimonial removed, please contact us at legal@prodigydanceconvention.com.

Videos

We retain video and audio recordings of the sessions which we post on our Instagram channel and other media.

Third Party Advertiser

We may share advertisements from partners including past and current marketing partners.


Consent To Electronic Communications and Text Messages

By using the Services, you consent to receiving certain recurring electronic communications from us as further described in this Privacy Policy.

Except as otherwise set forth in this paragraph, by using the Services, you consent to receive text messages from us at the mobile number you provide when interacting with our Services. These messages may include promotional content.

You may receive a text message from us in relation to use of the Sites and Services. You can stop receiving text messages from us at any time by replying 'STOP' to the message or following the opt-out instructions as otherwise indicated in the text message. To the extent indicated in the text message, you may reply 'HELP' if you need assistance. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary and depends on your interaction with the Company, the Sites and the Services. You should contact your wireless provider with any questions. Cookies and Other Tracking Technologies

We may use various methods and technologies to store or collect Usage Information ("Tracking Technologies"). Tracking Technologies may set, change, alter or modify settings or configurations on your Device. A few of the Tracking Technologies include, without limitation, the following:

  • Cookies. A cookie is a file placed on a Device to uniquely identify your browser or to store information on your Device.
  • Web Beacons. A Web Beacon is a small tag (which may be invisible to you) that may be placed on our Sites pages and messages to track activity and transmit data back to us.
  • Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Sites.
  • ETag, or entity tag. An Etag or entity tag is a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL.
  • Browser Fingerprinting. Collection and analysis of information from your Device, such as your operating system, browser type, and available fonts.
  • Recognition Technologies. Technologies, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices.

We may use Tracking Technologies for a variety of purposes, including:

  • To allow you to use and access the Sites, including for the prevention of fraudulent activity and improved security functionality;
  • To assess the performance of the Sites, including as part of our analytic practices or otherwise to improve the content, products or services offered through the Sites;
  • To offer you enhanced functionality when accessing the Sites, including identifying you when you sign into our Sites or keeping track of your specified preferences; and
  • To deliver content relevant to your interests on our Sites and third party sites based on how you interact with our content.

Users can opt-out of certain Google®-related tracking technology and customize the Google® Display Network ads that they receive by visiting the Google® Ads Settings page. Why We Collect Personal Information

We may use your Personal Information for various purposes, including:

  • Responding to requests for information
  • Providing, developing, customizing and improving your services
  • Fulfilling your requests for services
  • Verifying your identity and for fraud prevention
  • Creating accounts
  • Providing you with updates and information about services we provide
  • Creating user preferences regarding emails and other correspondence
  • Sending you marketing information about Prodigy and our affiliated entities
  • Sending you email and text communications such as electronic newsletters about our Services which may be of interest to you
  • Improving the effectiveness of our Sites, our marketing endeavors, and our product and service offerings
  • Helping us address problems with and improve our Sites and our products and services, including testing and creating new products, features, and services

When We Disclose Personal Information

We may disclose your Personal Information in the following circumstances:

(a) To Third Parties Providing Services to Prodigy

We may use Third-Party Service Providers to perform certain services on behalf of us or the Sites, such as (i) to assist us in operations; (ii) to provide marketing assistance; (iii) to perform Site-related services (including without limitation, maintenance services, database management, web analytics and improvement of the Sites' features); or (iv) to assist us in analyzing how our Services are used.

Without limiting the foregoing, with your permission, we may share your Personal Information with those Third-Party Service Providers by whom you request services. We may provide these vendors with access to user information to carry out the services they are performing for you or for us.

We use the following third-party service providers:

  • Squarespace – for website hosting and form submissions
  • Calendly – for scheduling meetings, webinars, and recruiter appointments
  • Square – for secure payment processing
  • Zoom – for webinars, recruiter events, and virtual sessions
  • Google Workspace and Dropbox – for internal documents and dancer material sharing
  • Mailchimp – for email marketing and newsletter campaigns
  • Adobe Creative Cloud and Canva Pro – for content creation, digital assets, and marketing materials

(b) To Protect the Rights of Prodigy and Others

To the fullest extent permitted by applicable law, we may also disclose your information when required to by law or if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety or property of Prodigy or third parties; (ii) prevent or investigate possible wrongdoing in connection with the Services; (iii) enforce our Terms of Use; or (iv) comply with applicable law or legal process.

(c) Disclosure to Law Enforcement

We reserve the right to release current or past personal information: (i) in the event that we believe that the Services are being or have been used to commit unlawful acts; or (ii) if the information is subpoenaed. Where permitted by applicable laws, we will provide you with prior notice before releasing your information in response to such requests.

(d) In Connection with a Business Transfer

We also reserve the right to disclose and transfer all information: (i) to a subsequent owner, co-owner or operator of the Sites and/or our Services; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including during the course of any due diligence process.

(e) To Affiliates of Prodigy

We may provide information to affiliates and nonaffiliated third parties who perform services or functions for us in conjunction with our services to you, but only if we have a contractual agreement with the other party which prohibits them from disclosing or using the information for any purpose other than performing services for us.

(f) On the Basis of Consent

Where you provide consent, we share your information as described at the time of consent, such as when authorizing a third-party application or website to access your Prodigy account or participating in promotional activities by Prodigy or third parties.

(g) Marketing

As explained in the Marketing Information section above, we also may share your information, including your Personal Information, with our affiliates and other third parties, such as companies with whom we have marketing or other relationships, for direct marketing purposes. In addition, we may share the information we have collected about you, including Personal Information, as disclosed at the time you provide your information and as described in this Privacy Policy.

(h) For Internal Business Processes and Promotion

Where permissible under applicable law, we may use certain information about you, such as your email address, de-identify it, and share it with social media platforms, to generate leads, drive traffic to Prodigy, or otherwise promote our Services.

(i) To the Other Users of the Services

We may share information about you, such as your username, and other information that will help others understand your connections with others using our services. Your account privacy settings may allow you to limit the other users who can see the personal information in your profile.


Integrating Social Networking Services

One of our unique features allows you to enable or log in to the Services via various social networking services like Instagram and TikTok ("Social Networking Service(s)"). By directly integrating these services, we make your online experiences richer and more personalized. To take advantage of this feature, we may ask you to log into or grant us permission via the relevant Social Networking Service.

You may also have the option of posting your activities to Social Networking Services when you access content through the Sites (for example, you may post to Instagram that you performed an activity on the Sites or attended one of our competitions); you acknowledge that if you choose to use this feature, your friends, followers and subscribers on any Social Networking Services you have enabled will be able to view such activity.


Aggregated Information

We may aggregate, de-identify, and/or anonymize any information collected through the Sites or Services such that such information is no longer linked to your personally identifiable information. We may use and/or share such aggregated, de-identified or anonymized information for any purpose, including for research and marketing purposes.


Your Rights and Choices About the Personal Information We Collect

You may choose to restrict the collection or use of your Personal Information in the following ways:

  • Whenever you are asked to fill in a form on our website or our other Services, consider what information to include and exclude.
  • We may provide you with access to your registration information and the ability to edit this information in your account settings dashboard and profile pages. Please be aware that even after you delete information from your account, copies of that information may remain viewable elsewhere.
  • Some of our Services may provide you with additional information and choices about your privacy, which you should review.
  • If you have previously agreed to our using your Personal Information for direct marketing purposes, you may change your mind at any time by writing to us at legal@prodigydanceconvention.com or clicking the unsubscribe link at the bottom of any email we send you.

We will try to comply with your request(s) as soon as reasonably practicable.

Administrative Correspondence. Please also note that if you do opt-out of receiving marketing-related emails from us, we may still send you messages for administrative or other purposes directly related to your participation in the Services, and you cannot opt-out of receiving those messages.


Retention of Personal Information

We retain Personal Information that you provide to us where we have an ongoing legitimate business need to do so (for example, as long as is required in order to contact you about our Services, or as required by applicable law).

We regularly review collected data and set data retention policies in order to delete data in accordance with contractual agreements, legal obligations and applicable data protection laws.


Children's Privacy

Protecting children's privacy is important to us. Our events may involve minors, including children under the age of 13, and we may collect Personal Information about them when a parent or legal guardian provides it to us. By providing us with Personal Information about a child, you represent and warrant that you are the child's parent or legal guardian, or that you otherwise have legal authority to do so, and we may rely on that representation.

Parents and legal guardians may review the Personal Information we have collected from their child under 13, request that we delete it, and refuse to permit further collection or use of their child's information by contacting us at legal@prodigydanceconvention.com.


Visitors to the Sites Outside of the United States

If you are visiting the Sites from a location outside of the U.S., your connection will be through and to servers located in the U.S. Information you receive from the Sites will or may be created on servers located in the U.S. All such information will be transferred to, processed, and stored in accordance with U.S. law and this Privacy Policy.


Updating Personal Information

We prefer to keep your Personal Information accurate and up to date. If you would like to change your contact information, please contact us as set forth above.

If so, we will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable (but we may retain prior information as business records). Please note that it is not always possible to completely remove or delete all of your information from our databases.

In addition, please note that if you implement a deletion request but later sign up for information or Services, your most recent request will control our information relationship with you.

For your convenience, the Sites(s) and this Privacy Policy may contain links to other websites. Prodigy is not responsible for the privacy practices including their use of AI, advertising, products, services, or the content of those other websites.


Security

We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, mobile networks, wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use our Sites and provide us with your information at your own risk.


California Privacy Rights

Under the Shine the Light law, California residents may request certain information regarding Prodigy's disclosures in the prior calendar year, if any, of their Personal Data to third parties for the third parties' direct marketing purposes. Nevada Privacy Rights

If you are a Nevada resident, you have the right to request certain information from us regarding the collection and sale of your personal information (as defined in Nevada Revised Statutes 603A.320). To make this inquiry, please submit a request by contacting us at legal@prodigydanceconvention.com.

As a Nevada resident, you may also request to opt out of us sharing such information about you. We will process your request within 60 days, or we will let you know if we need additional time. We may require additional information to verify your identity before we can respond.


Global Privacy Control

Where required by applicable law (for example, in certain U.S. states), we recognize and honor Global Privacy Control ("GPC") and similar browser- or device-level opt-out preference signals as a request to opt out of the sale or sharing of personal information.


Do Not Track

Do Not Track ("DNT") is a web browser setting that requests that a web application disable its tracking of an individual user. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, analytics companies, advertising networks, plug-in providers, and other web services you encounter while browsing to stop tracking your activity.


International Data Transfers

Because Prodigy works with global companies and technologies, we may transfer your Personal Information outside of the country in which it was originally provided. This may include transfers to third countries that do not have data protection laws equivalent to those in your country. When we do so, we take appropriate measures to protect your information in accordance with applicable law.


Changes to Our Privacy Policy

General Privacy Notice for US Residents

Residents of certain states in the United States may have additional rights in the future and Prodigy will update this policy as and when such laws become applicable to us.

This Supplemental Policy describes Prodigy's practices regarding the collection, use, and disclosure of Personal Information and provides instructions for submitting data subject requests.

This Notice does not apply to personal information that we process as a service provider on behalf of our customers.

Your Rights to Your Personal Information

Generally, the rights available to residents of the United States under various privacy laws can be categorized as follows:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.
  • Correct inaccuracies in their personal information, taking into account the information's nature and processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Processing of Sensitive Information: We must obtain your express consent prior to collecting and processing certain categories of sensitive personal data such as precise geolocation data, data about protected characteristics and genetic or biometric data.

Non-Discrimination: Prodigy will not discriminate against customers who exercise their rights under state privacy laws.

Personal Information of Minors

Protecting children's privacy is important to us. For that reason, no part of our Sites is targeted to attract anyone under the age of 13. However, our events are targeted towards high school students, many of whom are under the age of 18. We also have events designed for dancers aged 12 and up.

Therefore, since the competitions do involve minors, including children under the age of 13, we may collect such information when their parent or guardian provides it to us for a particular purpose. For example, parents register their children as dancers for events. However, we do not solicit this information from the child directly.

If you provide us with information about a child, you represent and agree that you have the legal authority to do so and we may rely on that representation.

Financial Incentives for Consumers

We do not have any programs which provide financial incentives for consumers.

Exercising Access, Data Portability, and Deletion Rights

To exercise any of these rights, you can submit your request by contacting us at legal@prodigydanceconvention.com. We will respond to your privacy requests within 30 days and notify you of the action(s) we have taken or required steps to fulfill the request.

Only you or a person registered with the appropriate state authority that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
